These Terms and Conditions ("Terms") govern your access to and use of the Fresh Frontier website (freshfrontier.in) and mobile application (the "App") (collectively, the "Platform"), operated by FRESH FRONTIER TECHNOLOGIES PRIVATE LIMITED ("we," "us," or "our"), a company incorporated under the laws of India with its registered office at OFFICE NO. 509, 5th FLOOR LUNKAD SKY STATION, NEAR HDFC BANK, VIMAN NAGAR, PUNE - 411014. By accessing or using the Platform, placing an order, or engaging with our services, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

We reserve the right to update or modify these Terms at any time. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

1. Description of Services

The Fresh Frontier Platform is a quick commerce service specializing in the sale and delivery of organic products, including fresh fruits, vegetables, groceries, and other natural items. We provide fast, reliable delivery of high-quality organic goods directly to your doorstep, typically within a short timeframe (e.g., 30-60 minutes, subject to availability and location). Our services are available in select areas, primarily in Pune and surrounding regions, and may expand over time.

All products are sourced from certified organic suppliers to ensure freshness and quality. However, availability may vary based on seasonal factors, supply chain issues, or other circumstances beyond our control. The App and Website offer features such as browsing products, placing orders, tracking deliveries, and managing user accounts for a seamless customer experience.

2. Eligibility

To use the Platform and our services, you must be at least 18 years old or the age of majority in your jurisdiction. By using the Platform, you represent that you meet these requirements. We may refuse service or terminate accounts if we believe you do not comply.

3. Account Registration

To place orders or access certain features, you must create an account by providing accurate information such as your name, email address, phone number, and delivery address. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate your account for any reason, including violations of these Terms. For App users, you grant us permission to access device features necessary for functionality, such as location services for delivery.

4. Products and Pricing

• Product Descriptions: We strive to provide accurate descriptions, images, and pricing for all products. However, errors may occur, and we do not warrant that product details are error-free. Colors, sizes, and appearances may vary.
• Organic Certification: Products labeled as "organic" are sourced from suppliers claiming compliance with relevant organic standards (e.g., NPOP in India). We do not independently verify certifications and make no guarantees beyond supplier representations.
• Pricing: Prices are listed in Indian Rupees (INR) and are subject to change without notice. Prices exclude applicable taxes, delivery fees, or other charges, which will be added at checkout.
• Availability: Products are offered subject to availability. We may substitute items if the ordered product is unavailable, or cancel orders with a full refund.

5. Ordering and Payment

• Placing Orders: Orders are placed through the Platform and are binding once confirmed. We may accept or reject orders at our discretion.
• Payment: We accept payments via credit/debit cards, UPI, net banking, wallets, or cash on delivery (where available). All transactions are processed through secure third-party gateways. You authorize us to charge your payment method for the total amount, including taxes and fees.
• Taxes: You are responsible for all applicable taxes, duties, or levies.
• Order Confirmation: Upon successful payment, you will receive an order confirmation via email, SMS, or in-app notification. This does not guarantee delivery; we may cancel orders due to unavailability or other issues, with a refund issued.

6. Delivery and Shipping

• Quick Commerce: We aim for rapid delivery, often within 30-60 minutes, but times may vary based on location, traffic, weather, or demand. Delivery is free above a minimum order value (as specified on the Platform); otherwise, fees apply.
• Delivery Areas: Services are limited to supported locations. Enter your address at checkout to confirm eligibility.
• Risk of Loss: Title and risk of loss pass to you upon delivery. Inspect products upon receipt; report issues immediately.
• Failed Delivery: If delivery fails due to incorrect address or unavailability, we may charge additional fees for re-delivery or cancel the order.
• App-Specific Features: The App may use GPS for real-time tracking and optimized routing.

7. Returns, Refunds, and Cancellations

• Cancellations: You may cancel orders before dispatch. Once dispatched, cancellations are not possible.
• Returns: Due to the perishable nature of organic products, returns are generally not accepted unless products are damaged, defective, or incorrect. Notify us within 2 hours of delivery with photos via email, the App, or Website.
• Refunds: Eligible refunds will be processed to your original payment method within 7-10 business days. We do not refund delivery fees for customer-initiated returns.
• Quality Issues: If products do not meet freshness standards, we may offer replacements or refunds at our discretion.

8. Intellectual Property

All content on the Platform, including text, images, logos, software, and App code, is owned by us or our licensors and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent. "Fresh Frontier" and related marks are our trademarks.

9. User Conduct and Content

You agree not to:

• Use the Platform for unlawful purposes.
• Upload harmful content, viruses, or spam.
• Interfere with the Platform’s functionality.
• Impersonate others or provide false information.

Any user-generated content (e.g., reviews, ratings) grants us a non-exclusive, royalty-free license to use, modify, and display it.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Platform or products, including loss of data, profits, or personal injury. Our total liability shall not exceed the amount paid for the relevant order.

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Products are provided "as is," and we do not guarantee they are free from allergens or suit specific dietary needs. For App users, we are not liable for any issues arising from device compatibility or third-party app stores.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms, misuse of the Platform, or infringement of third-party rights.

12. Force Majeure

We are not liable for delays or failures due to events beyond our control, such as natural disasters, strikes, or supply shortages.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be resolved exclusively in the courts of Pune, Maharashtra.

14. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your data, including location data for App users.

15. Miscellaneous

• Severability: If any provision is invalid, the remaining Terms remain enforceable.
• Waiver: No waiver of any term is a waiver of subsequent breaches.
• Entire Agreement: These Terms constitute the full agreement between you and us.
• App-Specific Terms: By downloading the App, you agree to comply with the terms of the applicable app store (e.g., Google Play, Apple App Store).
